TATTOO CLIENT AGREEMENT AND WAIVER

Welcome to Bleed Ink! We are thrilled to have you as our valued client. Before we proceed with your tattoo appointment, we kindly ask you to carefully read and agree to the following terms and conditions:

1. Informed Consent

1.1. I acknowledge that I have been fully informed of the inherent risks associated with getting a tattoo. I understand that these risks, known and unknown, can lead to injury, including but not limited to infection, scarring, difficulties in detecting melanoma, and allergic reactions to tattoo pigment, latex gloves, and/or soap.

1.2. Having been informed of the potential risks associated with getting a tattoo, I still wish to proceed with the tattoo application and freely accept and expressly assume any and all risks that may arise from tattooing.

2. Waiver and Release

2.1. I agree to waive and release, to the fullest extent permitted by law, each of the Artists and the Tattoo Studio from all liability whatsoever, for any and all claims or cases of action that I, my estate, heirs, executors, or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the application of my tattoo, whether caused by negligence or fault of either the Artists or the Tattoo Studio, or otherwise.

2.2. I release all rights to any photographs or videos taken of me and my tattoo and give consent in advance to their reproduction in print or electronic form for social media or marketing purposes by Bleed Ink.

3. Deposit Rules and Appointment Cancellation/Reschedule Policy

3.1. A non-refundable deposit is required to secure your tattoo appointment. The deposit amount will be communicated to you during the booking process and must be paid to confirm and secure your appointment. Failure to pay the deposit within the specified timeframe may result in the cancellation of your appointment.

3.2. In the event that you need to reschedule your appointment, we require at least 48 hours' notice. If you provide timely notice, your deposit will be applied to the new appointment date. If you fail to provide timely notice or do not show up for your appointment, your deposit will be forfeited.

4. Health Declaration

4.1. I do not have diabetes, epilepsy, hemophilia, a heart condition, nor do I take blood thinning medication.

4.2. I do not have an allergy to anything that would be used during the entirety of the tattoo process (i.e. latex, tattoo ink, metals, soap, etc.).

4.3. I do not have any other medical or skin condition that may interfere with the application or healing of the tattoo, including but not limited to Psoriasis, AIDS, HIV, Herpes, or other STIs (at the procedure site), other bleeding or bloodborne pathogens, etc.

4.4. I am not the recipient of an organ or bone marrow transplant or, if I am, I have taken the prescribed preventative regimen of antibiotics required by my doctor in advance of any invasive procedure such as tattooing or piercing.

4.5. I am not pregnant or nursing.

4.6. I do not have a mental impairment that may affect my judgment in getting the tattoo.

5. Compliance with Health Declaration

5.1. If I do have any of the conditions listed above (subsection 4), I will check off the box marked below and immediately inform Bleed Ink and/or the Artist of the condition(s).

5.2. I understand that failure to comply with this policy may lead to legal action against myself by either Bleed Ink and/or the Artist, in which I will be responsible for covering any and all legal fees incurred by Bleed Ink and/or the Artist in pursuit of said legal action.

6. Sobriety and Voluntary Consent

6.1. I am not under the influence of alcohol or drugs, and I am voluntarily submitting to be tattooed by the Artist without duress or coercion.

7. Acknowledgment of Understanding

7.1. I agree that both the Artist and/or Bleed Ink have given me the full opportunity to ask any and all questions about the application of my tattoo, and all of my questions have been answered to my total satisfaction.

7.2. I consent to the application of the tattoo and to any actions or conduct of the representatives and employees of Bleed Ink reasonably necessary to perform the tattoo procedure.

7.3. I acknowledge that I have been given adequate opportunity to read and understand this document, and that it was not presented to me at the last minute.

8. Legal Contract

8.1. I understand that I am signing a legal contract waiving certain rights to recover against Bleed Ink and its Artists.

8.2. If any provision, section, subsection, clause, or phrase of this release is found to be unenforceable or invalid, that portion shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable portion had never been contained in this document.

9. Completion and Rescheduling

It is also important to note that we, as Bleed Ink artists, are more than capable of completing agreed-upon work or full pieces based on our estimated time frame given. However, in any cases involving the inability to finish the piece due to client-specific circumstances, there will be added fees predetermined by the artists and client beforehand. These fees are used as a precaution to give the artists flexibility to reschedule, extend, or rebook an additional session to continue the said project at a later date.

10. Preparing for Your Tattoo

Lastly, diligently prepare before your tattoo appointment. Do all the things necessary to ensure a smoother experience and avoid activities advised beforehand. This will ensure a greater experience between you, your artist, and the outcome of your work.

11. Age and Competency

11.1. I hereby declare that I am of legal age (and have provided valid proof of age) and am competent to sign this Agreement. If not, my parent or legal guardian shall sign on my behalf, and they are in complete understanding and concurrence with this agreement.

Tattooing is a serious and permanent decision, and it's essential for both parties to understand and acknowledge their responsibilities and rights.
